Terms of Service

These Terms of Service ("Terms") govern your use of HST Hero ("Service"), operated by HST Hero ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of Service
HST Hero is a revenue-tracking tool designed to help Canadian sole proprietors and small business owners monitor their rolling 12-month revenue against the $30,000 GST/HST registration threshold. The Service provides calculations and informational estimates only.
HST Hero is not a tax advisor, accountant, or legal professional. Nothing on this Service constitutes tax advice. Always confirm your obligations with the Canada Revenue Agency (CRA) or a qualified tax professional.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
3. Your Account
You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at support@hsthero.ca if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Scrape, crawl, or automate requests to the Service without permission
- Transmit malware, spam, or other harmful content
- Impersonate any person or entity
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
6. Fees, Billing, and Cancellation
The Service offers a free plan and a paid “Pro” subscription ($5.99/month or $49/year, in Canadian dollars, plus applicable taxes). Payments are processed by Stripe; we do not store your payment card details.
- Automatic renewal — Pro subscriptions renew automatically at the end of each billing period (monthly or yearly) and your payment method is charged at renewal, until you cancel.
- Cancellation — you may cancel at any time from the Settings page. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
- Refunds — except where required by applicable law, fees already paid are non-refundable and we do not provide prorated refunds for partial billing periods.
- Price changes— we may change subscription prices with at least 30 days’ advance notice by email; changes apply from your next renewal, and you may cancel before they take effect.
From time to time we may offer one-time paid services (such as the $99 threshold and Quick Method check). These are informational reviews of the figures you provide, are delivered by email, and are not tax, accounting, or legal advice. One-time fees are non-refundable once the deliverable has been sent.
7. Intellectual Property
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are owned by HST Hero and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the calculations produced are accurate or complete. Tax rules change — verify all figures with the CRA.
9. Limitation of Liability
To the fullest extent permitted by applicable law, HST Hero shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue or profits, arising from your use of the Service, even if we have been advised of the possibility of such damages. Without limiting the foregoing, you are solely responsible for determining whether and when you must register for, collect, and remit GST/HST; HST Hero’s calculations are informational estimates based on the data you enter, and we are not liable for penalties, interest, or assessments imposed by the CRA or any tax authority.
To the fullest extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim, and (b) $50 CAD. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from the Settings page. Upon termination, your data will be permanently deleted.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
